Lisa, if it puts your mind at ease, the horse accident happened when one horse rubbed its head against the other's, and wound up rubbing horse #2's bridle off. I doubt it's the kind of thing that would or even could happen at your daughter's horse camp.

Of course, if this DOESN'T put your mind at ease, just forget I ever wrote anything. Hey, look at the butterfly! ...

JIM C. that article you linked us to about the gulf of Mexico by Geologist Reed was really interesting. Even got hubby to interact regarding his theory. When it comes to that topic, DJH doesn't like to get too involved. Said it makes his worry registry overload.

I do think now that you are on the right track on the subject of the New Madrid Fault. Many reasons why and it does have the possibility of involving all of us. We'll know when it blows, won't we!

Day #1- Survived Horse Camp w/o incident.Other than this smarty pants girl saying "BYE BYE" w/a grin as she passed Lorraine on her horse. (Lorraine's horse wouldn't budge & was being stubborn as a Mule.)The stories I hear from these young girls interacting are really something. Quite caddy! (There are eleven in this group.)

My niece worked for a man and his wife from Israel, Itimar and Natti. They are in their early 40s.

Monday Natti had a headache (she's had them a long time). Itimar told her he'd take her to the hospital. In the few minutes it took him to get ready, Natti became unconcious and has been ever since.

The doctors said that Natti had a stroke. She's still unconcious, and the docs are saying it's day to day.

Anyone who knows Candice knows it must be critical for her to reach out to a prayer chain, but she truly does believe in God's awesome power. It will give their family comfort and strength knowing that we are joining in prayer and lifting Natti to Him.

Faithful and dependable

A hot morning shower, a fresh cup of coffee. The lights in your kitchen and bathroom. What would you do if you were deprived of the basics of your dependable morning routine? Many of us would start shutting down. It's easy to take hot water and electricity for granted. The same is true of faithful love. It's easy to take for granted the person who is always there to listen to your problems. It's easy to take for granted the person you run to when you're frustrated or in trouble. It's even easier to take for granted God's faithful care for you and your family. Every day God sustains the world in which we move and live. He provides food, clothing, and opportunities for employment. Most important, he showers love and concern on us every day. Our God is a faithful God. He is entirely dependable.

That same type of faithful and dependable love is the foundation of every strong relationship. Love is cheap if it's given only when things are going fine. Our love for others must be consistent and dependable.

Today I saw another Muslim woman wearing a Burqa @ Costco in our one horse town.

This is the strangest thing ever. I have NEVER seen this before now.

Her get-up didn't have the black screen mesh over the face but she was in all jet black w/just eye slits.

I have TRUELY entered the Twilight Zone..........

In our neighboring city of Ft. Smith, we see quite a few of the Muslim women out shopping in various businesses and all are wearing the burqas. Some are rather serious looking but most are moderate. No one seems to pay much attention to them and there have been a few times when the women have been rude, cutting in front of any of us. But, seeing the drama that they live in, just extending a bit of grace, seems rather a small price to pay. One of the ladies in particular now knows me by my name (had a name tag on one day) and she was really excited to show me her new grand baby. Even allowed me to hold her. I know her name also and she is on my prayer list. God loves them also.

Hi everyone,
Need prayer please. I have had some symptoms that my doctor has yet to diagnose. He said to call him in two weeks(two weeks ago) if the symptoms do not go away. He thought that I may have a virus. I had severe vertigo about a month ago (had to go to ER since I had never experienced it before!)pain in arms and legs (it comes and goes; burning pain or constant ache), muscle twitches, spasms and cramps in legs, sometimes muscle twitches in arms and a few other places too. One day I will fell ok but then later in the eveing I will ahce and have horrible legs muscle spasms. Last evening was a bad one after a lovely day at the park with the kids. I guess I just really need to know what is going on, and to see a good doctor. I know it looks like MS but perhaps is somehting else. Doc did a bunch of blood work and said everything is normal there.
Please pray for an answer!

Oh, and I was fired from a job that I had just started the month prior due to missing too many days after the vertigo incident which had left me fatigued for days after!

URBANA, Ill. -- The University of Illinois has fired an adjunct professor who taught courses on Catholicism after a student accused the instructor of engaging in hate speech by saying he agrees with the church's teaching
that homosexual sex is immoral.

The professor, Ken Howell of Champaign, said his firing violates his academic freedom. He also lost his job at an on-campus Catholic center.


He lost his job at the Catholic center because that position requires that the person be a University employee.

Praying for your return to good health and no dizziness of any kind.

We just returned from a long trip to Ft. Smith so hubby could attend a business friend's retirement celebration. Hubby was really feeling old at 82 plus a few months but this friend is at least 1 1/2 years old than DJH and just now hanging up the shingle to enjoy some recreation. DJH came home feeling a whole lot younger this evening. Anything to make a transition possible.

I received a letter from the Kenneth Copeland Ministries today and Ft. Worth is declaring itself open and friendly to the homosexual elements no matter what direction they go, just as long as they aren't Christian and Straight. The Ministry has asked that we all be praying and also, contacting the Ft. Worth city government to voice our lack of support for this move. As far as I know, no one has ever mistreated these individuals and why in world are they separating them out for special consideration? It has to do with MONEY! and lots of it. Of course, BOO HOO gets most of the credit but people, the Days of Noah are here but then so are the days of Sodom and Gomorrah. If I was sitting that close to the Gulf of Mexico and the situation as it now stands, I would be calling on all of the Christians and Jews to intercede for Texas and especially their locale.

Do you feel the hairs on your head getting higher and higher? I do!

in answer to your question "where do people come up with this stuff?"--nose candy! I had no idea what that meant until the conversation a few weeks back when BOO slipped away from his Sec. Serv. contingent and they accused him of going for some "nose candy". Funny things that you find answers to on the internet but especially Google.

he's crazy that much is obvious Lisa. At a guess patient is has paranoia with delusions of grandeur and I seriously doubt the Queen is stepping down for him anytime soon. I'd chalk this one up to mental illness and nothing else nefarious.

Pray for some of us at our church. There are many who love Israel dearly at our church and the PCUSA general assembly just voted this last week to endorse the Kairos document-a travesty. per someone interviewed on the Prager show those who endorse Kairos are within the minority in the PCUSA but somehow they managed to get it through. I think if the individual presbyteries get to vote on it it will be quashed. They also voted against the redefinition of marriage but the board of pensions has been urges to give benefits to those with same sex partners. We are starting to look elsewhere for a church I think. Too bad as the pastor we have is quite sound but DH and I are struggling with this.

Lisa, I may have run across "this guy" before. All I can say is that it's people like him that give conspiracy theorists a bad name! He appears to be linked with the "British Israel" movement, which teaches that Britain was settled by the lost 10 tribes, and as such the British monarchy contain the last living remnant of the Davidic line. Which means that when Jesus comes again, he will do so sitting on the Throne of England.

I wonder if "Brian Leonard Golightly Marshall" is related to Matreia?

(I have to confess: when I read the name "Golightly", all I could think of was "Holly Golightly" from "Breakfast at Tiffany's". "She's a phony, but she's a real phony.")

Thanks for the prayers everyone. I figure if there is something wrong that will not go away and may even be progressive then the Lord can and will certainly use that to His glory. I have family members who need saved and a teen duaghter who needs to recommit to the Lord and if I have some sort of illness then it would be such a good thing to have it if the Lord used me in such a way as to bring glory to Him through those people turning to Him!

Jib; they checked my thyroid along with cbc, metabolic panel, B12, ANA, glucose and some other things relating to autoimmune disorderes. My glucose has actually been checked twice but neither were fasting glucose tets and they both came back fine.I'll let you all know once I find something out. I have been asking the Lord to let me know what it is, to give me a good doctor to diagnose.

Have a wonderful time in NY. I don't know where you're going there, but if by chance you get near Niagara Falls, there is the most beautiful state park an hour away in NY called Letchworth State Park. It's quite large and is referred to as "The Grand Canyon East of the Mississippi."

Enjoy the heat, Mac & Alesia! We've been feeling like bedouin in the desert the last few weeks here in Philly....grass is so dried out that dust kicks up with every step and all firework displays were cancelled for the 4th bc of fire hazards. The 90 degrees this week actually feels comfortable!

My DH got to travel to NYC 2 weeks after the 9/11 attacks and the rubble was still smoking. We went up for a weekend a year later and by then the site was cleared. Still very somber with the surrouding buildings draped and the fences lined with memorials. My favorite photo is of the steel cross that was created when the beams sheared off.

Cool time in the Okie hills and if you are looking for a sauna before dipping into a cool swimming pool, just step outside for a few minutes. Somebody got the routing directions mixed up for our weather this year and that is what they get for using the USPS to deliver the goods.

we are sweltering also. heat index here for the weekend is supposed to be between 110-115! supposedly temps are supposed to get into the 90's at night but I was outside and it was more than 100 out still at 10pm so not sure when it got down to the 90's. our water is so hot right now we have no cold water coming out of the spigot.

but unlike you we don't have the humidity. the humidity has gone up to levels need for the monsoon rains to start but they have yet to do so and we realllly need some rain

You might be interested in this. There is a facebook page for the purpose of supporting Dr. Ken, the UofI prof that was fired. The page is called Save Dr. Ken. For the first few days after the story hit the local news we did not hear anything more or see any editorials in the paper. After about three or 4 days we are seeing great support for him. There is a large student group protesting. Even an athiest group on campus is supporting him and his right to free speech. There is an article about it on Fox News this morning.

I know this is going to upset some but I have to say it. A copyright is a legal instrument put in place by the author, creator of the material or company. It is done to protect their original product, whether it be music, books, videos or anything they have created. The laws have been on the books for a long time and just because this is the internet does not mean those laws can be ignored.

I have marveled at youtube getting past the copyright laws of artist and producers. Let's say you take the time to author a book, spend the money to have it produced and then market it for receive just payment for your work; wouldn't it jell your blood cells just a wee bit if someone recopied it and put it out on the vast expanse of the internet?

I have no pity for these people when they knew what they were doing was shop lifting in a broad senses of the word. Don't even try to pass the "they didn't realize they were doing anything wrong" bit on it. They knew the proper way to have access to the material was to purchase the article.

Another one not to try is "everyone was doing it and I just thought it was OK!" NOT! If there is crackdown in this sort of thing, it is long overdue.

That is my opinion on it and it will remain my opinion. What was a sin 3000 years ago is still a sin, no matter how modern we think the times are. Stealing is a criminal offense.

Nope! Don't watch it and believe me, it does not represent Oklahoma as I know it. In fact, if the star of that show would show up in Oklahoma they would probably put her in jail to learn some manners. Do you remember those old westerns that Clint Eastwood made about the wild west? Well, that was fiction also. The last known renegade like the character portrayed in "Saving Grace" would have been Belle Starr and now her direct descendants are all law abiding business men and women. In fact, I have been told that the Special Prosecutor in the Bill Clinton trials is a direct descendant of Belle's. Ken Starr.

Hollywood needs to do more homework.

If I seem cranky tonight it is simply due to the heat. We have all the fans, air conditioning, ice tea, ice water going full steam and it is still hot. Our house has brick veneer on all four sides and it hold the heat longer than wood does. The next house I plan on building will be made of mud, underground and away from all highways, streets and commercial buildings.

Grany, who said enforcing copyright laws, would upset anyone? I don't think as Christians (who are supposed to follow the laws) would be offended by that at all.

What they are trying to get across is that although they are in the right by cracking down on criminals- do they have to shut down that many bloggers to get at the few?

Is this a legit "test case"? A forerunner to heavy handedness over what is posted in the internet?

So if/when the "hate speech" law is fully enforced- will they shut down all of the Biblical Christian sites?

That is the aspect of the article that is concerning for Christians. Many feel that it is only a matter of time before we see this occur.

Donna, that actually doesn't sound so bad! If you check out some of the permaculture sites, you'll find some very interesting examples of such buildings.

The mud material is called "cob" or "cobb" (I've seen it spelled both ways), and it's a mixture of mud and straw. Think of it as an unfired adobe. After it dries, you can either leave it as is or you can cover it with a lime plaster (not concrete plaster, because the surface needs to breath). With a white lime plaster, you'll have a surface that will reflect a lot (but not all) of the sun's heat.

Unfortunately, cob's best attribute is that of a thermal mass (which is what Grany DOESN'T want right now). It has an R value of 0.5, meaning it's a lousy insulator, but it will store and release heat very well. This makes it an excellent choice where you have a lot of days that are very hot and nights that are very cold. If you add pumice to the cob at a 30% ratio, then you get SLIC -- Structural Lightweight Insulated Cob. This is cob that's strong enough to stand up to California's earthquake standards and has an R value of 1.

For future building, I'd recommend a Monolithic Dome. This is where a ring beam is poured with rebar, a form is attached to the rebar, then inflated. Once inflated, the inside is sprayed with foam. When the foam hardens, rebar is punched into it, leaving spaces for doors and windows. Then shotcrete (a mixture of concrete and nylon fibers) is sprayed onto the rebar to a depth of about 2 inches.

What you have then is an insulated concrete thermal mass that will take several months to warm up and then several months to cool down, evening out temperature fluctuations. It's possible to cool a 2,000 sq. ft dome with an air conditioner unit designed for an RV, and to heat the entire structure with a simple wood stove.

For now, your best bet is to get something to cover the brick walls on the sunward side. It might be too late to do anything this year, but in the future you can install a trellis and plant vines or ivy to block the direct sun from hitting the brick. You can also look at getting some kind of awning that you can put up in the spring (when you want to keep the sun from hitting the wall) and take down in the fall (when you want that sun's heat to heat up the brick).

I guess if I still thought Christianity today was a magazine reflecting true faith I'd be fairly mad but not so much. It is symptomatic of what is wrong with the church corporate today however. I don't know if you've read any of the stuff on my blog but I'm getting a little "heat" for lack of a better word for it. seems the elders would rather have a report on what the deacon's do or don't do on a monthly basis-the mundane if you will.

Thanks again. Yeah, Ruby is gorgeous! Everybody says she looks exactly like me. I would have thought looking like me and being cute would have been mutually exclusive. :-)

My wife says she hopes Ruby grows up to look like a girl version of me. I am not sure if that is a good thing or not. :-)

As for getting enough sleep, I am getting more than my wife.

We have to Yorkies that are just over a year old. One of them likes to yip when she wants to be let out in the morning. Frequently, this has been at 6:00 a.m. (or earlier) lately. She will hear my wife feeding Ruby and then decide it is time to bark.

It has become a bit of a vicious circle. Ruby is asleep and the Yorkies decide it is a good time to start fighting and barking. This, of course, frequently wakes up Ruby...or Ruby will cry and wake up the Yorkies.

Some nights, we have a really hard time getting Ruby to go to sleep. I was sitting on the couch with her, watching T.V. until 2:30 a.m. one night/morning until I finally got her to go to sleep. I very carefully slid to the edge of the couch, slowly got up and tried to ever so carefully walk out of the room towards the stairs. I got partway out of the room and one of the Yorkies started barking at me, which, of course, woke up Ruby.

It made me sorry I had saved the Yorkies from getting mauled by my parent's Malamute/Shepard cross a few months ago (completely tearing the ligament in my left thumb in the process, requiring months of recovery). It is a good thing my wife and I love those dogs so much or... :-)

Lisa, I wouldn't be so quick to cut down those women buying romance novels. For one thing, it's not a new phenomenon. In any and every used book store I've visited, the largest section has always been the romance novel section. For another thing, I recall a study several years ago that indicated that women who read romance novels were more satisfied with their marriages. I believe one reason given (but not proved) was that these women did not expect or require that their husbands be constant or ultimate "romancers".

I have been spending so much time tracking what is going on in U.S. politics (watching Glenn Beck every night, ordering almost every book he suggests (hopefully I will get a chance to read them all someday), and reading waaaayyyyy to many articles.

I have almost no idea what is going on in politics in Canada or my own city right now, as there is not time left to follow that as well.

Canada's economy is doing so much better (at least on the surface), than the U.S. economy.

Our PM, Stephen Harper, is a born-again Christian and a Conservative. These are two very rare things in Canada, as Canada is traditionally ridiculously liberal.

Unlike Obozo, Harper is actually an economist by schooling, so he actually knows something about finance (unlike the Harvard professor).

It is amazing the disconnect between the way that Canada and now Europe are cutting their deficits (realizing that the building is on fire and getting the heck out), while Obozo is running back into the building with a can of gas in his hand and trying to talk the others into following him.

That being said, that is really his plan isn't it? Obozo wants to destroy the U.S. economy, so he can insert a new system (Monopoly Communism). I shouldn't say Obozo wants to do this. It is the people who are pulling his strings that want to do this. They are going to throw Obozo away when they are through with him. Judging by his horrible polling numbers, that might be sooner rather than later.

So...is Hillary going to win in 2012? Wouldn't that be a treat? I see that Bill's numbers are a lot better than Obozo right now. Can he run again, or are you limited to 2 terms in a life time. We don't have any such sanity checks in Canada. We had Jean Chretien as PM for a miserable 10 years.

Bill Clinton can't hold the office of President again.

The 23rd Amendment to the U.S. Constitution states:

Section 1
No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President, when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.

Section 2
This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.

Thanks for the info. I think the two term limit was brought in almost immediately after FDR's death. He had been elected for four terms and people were scared that it might happen again. There sure are a lot of parallels between what FDR did in office and what Obama is doing and none of them are good.

Jim G., the key word in the amendment is "elected." There are (legal) ways around this. IN particular, you have a situation where Smith is elected President while Bill Clinton is elected to the Vice President position. Smith resigns as president so Clinton becomes president. If they want to try for two terms, have Congress make Smith VP; then we do the same dance again: Clinton resigns, Smith becomes president, Clinton is made VP; after the election the same thing happens all over again. Frankly, I can see this happening for one term, but I can't see the American people tolerating and approving such an end run around the intents of the Constitution.

I'm feeling a little snarky, because I've been reading about the Missouri Test Oath. Here's an article about it from the Catholic Encyclopedia. I have to quote from CE because it's one of those very important events in history that have been brushed aside.

The 1865 Missouri Constitution required that people take a very extreme loyalty oath before they could be jurors, lawyers, judges, etc. It also required that bishops, priests, or other clergymen "of any religious persuasion, sect or denomination", had to take the oath before they could "preach, solemnize marriage, or teach." Failure to file your sworn and signed oath would result in imprisonment and fines.

The Most Rev. Peter Richard Kenrick, Roman Catholic Archbishop of St. Louis sent a letter (written in Latin, as the privacy of the post could not be guaranteed) advised all the priests under him that taking the oath would be accepting that a civil authority had the authority to decide religious matters. He did not tell the priests not to take the oath, only that they should inform him if the law were enforced.

After the deadline passed, priests, bishops, and nuns (since they couldn't teach without taking the oath) were either arrested and imprisoned or went into hiding. This went on for two years until the US Supreme Court heard the case. In the end, they voted to strike down the Test Oath.

By one (1) vote.

Given the times we live in, I'm frightened by the fact that my ability to practice my faith (and your faith, too, since no one could preach the Word of God without first having taken the oath) hinged on a single vote. I'm even more concerned that this milestone in religious liberty has been so ignored that the only references I can find on them using Google refer either to the Catholic Encyclopedia, an Answers.com article on Test Oaths and another on Cummings v. Missouri, neither of which mention the religious nature of the original conviction, and a number of biographies of the Supreme Court justices at the time, saying how they voted.

If you type "Lake Delhi Rec Dam, IA" into Google Maps, you'll get a map of Eastern Iowa centered on the dam. I'm down by Iowa City. If you zoom in a couple of clicks, you'll see Hopkinton, and you can drag the map along the river to find Montecello. The river is BEAUTIFUL by Montecello, and I always love driving up there when the leaves change color.

But I'm not going to be driving anywhere near there for the next few days.

I'm always bothered when folks either confuse or fail to see the difference between the question of whether a law is unconstitutional and the question of whether a law is good public policy.

The proper role of the Supreme Court in my opionion is the former and not the latter. As Justice Miller wrote in the last line of his dissenting opinion to which three other Justices joined:
"...I have endeavored to bring to the examination of the grave questions of constitutional law involved in this inquiry those principles alone which are calculated to assist in determining what the law is, rather than what, in my private judgment, it ought to be."

It is an interesting case. Be sure and read the full dissenting opinion which applied to both this case and the next. The dissenting opinion can be found (near the end, of course) here:

Thanks for the links to the texts of the "CUMMINGS v. THE STATE OF MISSOURI" and "EX PARTE GARLAND" cases. I found the "EX PARTE GARLAND" case (and especially the dissenting opinion) most enlightening, as well as the most dangerous. It is well reasoned and contained a great many examples from previous decisions that I can understand and agree with. Unfortunately, it does so in such a way as to bolster current attempts to separate "worship" (those external acts that define belief) from "religion" (the internal conscience and interior act of will that define belief). The case cited ("Permoli v. Municipality No. 1 of the City of New Orleans", 1845) had to do with the ability of a local municipality to regulate matters of public health. During an outbreak of yellow fever, New Orleans passed a law stating that all funerals had to occur in the mortuary chapel. This was designed to minimize transmission of yellow fever and other illnesses, the law having been passed before the means of transmission of yellow fever were understood. (The solution, BTW, was eventually resolved through free enterprise, to whit, mortuaries who wanted to cater to the Catholic community built chapels on their properties that were consecrated for use by Catholics for funerals, thus answering both the needs of the law and the needs of the Catholic communities.) The Supreme Court, in deciding the case, held that it had no jurisdiction in the case. Using today's language, it held that this was not a case of "freedom of religion" but "freedom of worship", which was to be regulated by the individual states.

By citing this example, the Court equated an external act of worship with an interior act of belief. The Roman Catholic rules requiring that a funeral mass be held in a sanctified space is an external act of worship that can be suspended during times of necessity. (Why this wasn't done by the Archbishop of New Orleans at the time I don't know.) In the case of "CUMMINGS v. THE STATE OF MISSOURI", the dissenting opinion (which was attached to "EX PARTE GARLAND") made an equivalency to a lawyer's previous actions (i.e., external acts of worship) and his internal beliefs in saying that if someone thought the Confederate cause was just, then he can be considered forever tainted and thus unfit to practice law in Missouri. By equating the Missouri Test Oath with laws requiring judges to retire after reaching a particular age, the justices equated something that cannot change and applies to everyone (growing older) with an interior act of will, which is individual and CAN change.

The dissenting opinion wanted to say that the Supreme Court of the US did not have jurisdiction, since regulation of religious matters is relegated by the Constitution to the several states. What the dissenting justices failed to consider was the difference between worship and religion. As a matter of dogma Roman Catholic priests COULD NOT sign the test oath, not without breaking their sacred vows. One of the vows you take as a priest is to never reveal the contents of Holy Confession. (The priest is acting as a witness to what is being confessed to G_D, and offers absolution in the Name of G_D.) Literally hundreds of priests have died under torture rather than reveal the contents of Holy Confession. If you read the contents of Section 3 of the Missouri Constitution of 1865, you'll find that it is so broad, so all-encompassing, that I don't see how anyone in Missouri at the time could sign it without perjuring themselves. In the case of Roman Catholic priests, it's even more serious. Priests are required to provide succor and comfort to ANYONE AND EVERYONE, friend and foe alike. If a rebel band came and asked to sleep in the barn, the priest (under the rules of Christian charity) would be required to allow that, and also provide food and drink, unless there was some compelling reason otherwise. Since the contents of Holy Confession cannot be revealed (the Seal of the Confessional), for them to sign a statement saying that they had never advised any of the rebels would be either perjury or revealing of a confession. They also could not sign it if they had ever gone out to the field and offered spiritual comfort to any of the wounded or dying, since they could not offer it to one side and not the other. Thus, the Missouri Constitution, in regards to religion, did indeed "limit the free exercise thereof."

To me, this is clear. It is NOT clear, though, if you do not recognize the difference between worship and religion, which is where I believe most of the judicial system is at today. At least now, after reading the dissenting opinion, I understand why this case was argued as "bill of attainder" and "ex post facto" violations of the US Constitution, and not religious violations. While the constitution required the oath of lawyers, teachers, and religious workers, as far as I can find it was only applied against religious workers, and specifically against priests and nuns.

It looks to me like you misunderstood the Supreme Court's reasoning in that case. The Court in that case was not (as far as I can see) making some sort of distinction between "freedom of religion" and "freedom of worship."

From our modern day perspective, it might be hard to see but back then, the First Amendment was understood to apply to Congress but not the States. The language was (and is) quite clear. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Look up the legal doctrine known as "incorporation." Wiki has a good explanation here:

Anyway back in 1845, when the Permoli case was heard, nobody thought that the First Amendment placed any restrictions on state and local governments. Making a distinction between ""freedom of religion" and "freedom of worship" was not necessary. You can read the Supreme Court's opinion here:

'The Right Reverend A. Blanc, Bishop of New Orleans, testified that the dogmas of the Roman Catholic religion did not require that the dead should be brought to a church, in order that the funeral ceremonies should be performed over them; that this was a matter of discipline only; that the witness, as bishop of this diocese, had authorized the clergy to leave the cathedral, and not to officiate at funeral rites at the obituary chapel, and that these ceremonies might be celebrated at the house where the dead person expired, or at any other place designated by the bishop.'

One more thing.

Just because a Supreme Court opinion may seem dangerous does not mean it is wrong or legally flawed. People shouldn't come to the Supreme Court and argue that something is unconstitutional because it is "dangerous." Actually, there are many people who do argue that the Constitution should be interepreted with a view towards what is safe and pragmatic and most appropriate for today. It's sometimes referred to as a "living Constition" by those who like to allow Justices much latitude to find what they like in the Constitution and take out what they don't like. I'd prefer that this be done through the Amendment process outlined in the U.S. Constitution rather than through judicial fiat and legal gymnastics.

I think I'm feeling a little snarky, too but I rally do love you brother and always appreciate your thoughtful comments.
